Recent rulings of the 3rd Civil Chamber of the Court of Cassation place the burden on the landlord to prove that the claimed need is "genuine, sincere and compelling". In two-justified-notice cases, the requirement that both notices fall within the same lease year and relate to different months is strictly applied.
